But it can also involve billing for services that were never provided or charging more than the allowable amount for a service. While scams involving Medicare fraud and abuse can take many different forms, all of them aim to take advantage of the system in some way and steal taxpayer money.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMedicare fraud occurs across the board\u2014from doctors, hospitals, labs, to even beneficiaries who sell their numbers or give their cards to others,\u201d says Charles Clarkson of the <\/span><a href=\"https:\/\/seniormedicarepatrolnj.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Senior Medicare Patrol of New Jersey<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2 id=\"what-is-medicare-fraud\"><span style=\"font-weight: 400;\">What is Medicare fraud?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Centers for Medicare &amp; Medicaid Services (CMS) defines fraud as \u201cthe intentional deception or misrepresentation that the individual knows to be false or does not believe to be true\u201d and that is made \u201cknowing that the deception could result in some unauthorized benefit to himself or herself or some other person.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Medicare fraud is a huge problem for the government, costing American taxpayers around <\/span><a href=\"https:\/\/smpresource.org\/medicare-fraud\/dollars-lost-to-fraud\/\"><span style=\"font-weight: 400;\">$60 billion<\/span><\/a><span style=\"font-weight: 400;\"> every year. Health Payer Intelligence stated The CMS paid more than $160 million to Medicare Advantage claims for medications that were already paid for by Original Medicare.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Medicare is a great program with many resources, which sometimes causes criminals to take advantage of the system. There are two main ways that this happens: selling identification numbers and stealing identification numbers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A provider committing fraud could attempt to use a stolen Medicare number to order services or durable medical equipment\u2014like a knee brace\u2014without the beneficiaries&#8217; knowledge. Or providers might intentionally bill for services or items not provided so that they may collect the funds.<\/span><\/p>\n<h2 id=\"penalties\"><span style=\"font-weight: 400;\">Penalties for Medicare fraud and abuse<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Medicare fraud is illegal and considered a felony. Anyone who commits it could face criminal, civil, or administrative consequences including jail time, fines, or penalties\u2014like loss of medical licenses or exclusion from participating in any federal healthcare programs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Medicare fraud hurts everyone. \u201cMedicare fraud steals tax dollars that are coming out of every American\u2019s paychecks,\u201d said federal investigator Shimon Richmond in a video for <\/span><a href=\"https:\/\/videos.aarp.org\/detail\/video\/6054815368001\/shimon-richmond-gives-advice-on-how-to-prevent-medicare-fraud\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">AARP<\/span><\/a><span style=\"font-weight: 400;\">. \u201cIt steals from a program that is providing services that every American hopefully will be able to take advantage of or may need at some time.\u201d It\u2019s passed along to citizens in the form of higher taxes to cover the program and can result in decreased services for participants as plan administrators cut programs to cover rising costs.<\/span><\/p>\n<h2 id=\"medicare-fraud-examples\"><span style=\"font-weight: 400;\">Medicare fraud examples: How to identify Medicare fraud<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">For providers, Medicare fraud examples could be:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Falsification of patient records<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Misrepresenting information on healthcare claims<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Soliciting or paying bribes for referrals for services reimbursed by Medicare<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Providing unnecessary or excessive tests<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unbundling<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Double billing<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Waiving cost-sharing in the form of copays, coinsurance, or deductibles<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Phantom billing, or Billing for services not delivered<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">When committed by providers, Medicare fraud can include any act that involves the misuse or manipulation of protected health information for personal gain. Including billing patients with false claims,\u201d up-selling\u201d unnecessary services to pads bills, billing for missed appointments or paying for referrals of Medicare patients.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Medicare sets reimbursement rates for certain groups of procedures that should be performed together. Medical providers may unbundle the components and bill each one separately to increase their profits. This is called Unbundling.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For beneficiaries, Medicare fraud examples could be:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Letting others use your Medicare card<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Helping a doctor file false claims by having unnecessary tests<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Altering a prescription or selling the drugs to others\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Providing incorrect information to qualify for Medicaid<\/span><\/li>\n<\/ul>\n<h2 id=\"how-to-identify-medicare-fraud\"><span style=\"font-weight: 400;\">How to identify Medicare fraud<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">One way to identify Medicare fraud is by keeping a record every time you visit your doctor or health provider. This includes the date that services were received as well any equipment used during those visits. Check for mistakes in providers, services rendered, or dates of services. Were you at the doctor&#8217;s that day? Did you get that test?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the statement doesn\u2019t match your records, it could be an honest billing error. A quick phone call to your provider could clear the error. Or it\u2019s possible the Medicare program was billed for a service you did not receive.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fraud could be billing for services or supplies that were not provided. Abuse or waste could be a doctor excessively charging for services or supplies. Misusing codes, or \u201cuncoding\u201d, to increase the reimbursement amount from Medicare is another form of abuse. This could include upcoding or improper billing.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What are red flags for Medicare fraud?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Red flags for Medicare fraud include being offered services for free in exchange for your Medicare card number, being pressured into buying services that are more expensive, or being charged for durable medical equipment you have not yet received. Another big red flag is when someone claims they represent the government. A Medicare provider does not represent the government.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">How do people commit Medicare fraud?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Beneficiaries commit Medicare fraud schemes by allowing someone to use their Medicare card to receive care or supplies. Or they could sell their Medicare number to allow the provider to bill for services not rendered. Another way people commit Medicare fraud is by accepting money or a \u201cgift\u201d in exchange for their Medicare number.\u00a0<\/span><\/p>\n<h2 id=\"how-to-report-medicare-fraud\"><span style=\"font-weight: 400;\">How to report Medicare fraud<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If you find out that Medicare is being improperly charged for an item or service, use the info below to report the suspected fraud or abuse.<\/span><\/p>\n<table class=\" singlecare-table\">\n<tbody>\n<tr class=\"header-row\">\n<td><b>Medicare parts<\/b><\/td>\n<td><b>Contact<\/b><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Provider fraud or abuse under Original Medicare (Part A and Part B)<\/span><\/td>\n<td><span style=\"font-weight: 400;\">1-800-MEDICARE (1-800-633-4227) or <\/span><a href=\"https:\/\/oig.hhs.gov\/fraud\/report-fraud\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The U.S. Department of Health and Human Services \u2013 Office of the Inspector General<\/span><\/a><\/td>\n<\/tr>\n<tr>\n<td><span style=\"font-weight: 400;\">Provider fraud or abuse in a Medicare Advantage Plan or a Medicare drug plan<\/span><\/td>\n<td><span style=\"font-weight: 400;\">1-800-MEDICARE (1-800-633-4227) or The Investigations Medicare Drug Integrity Contractor (I-MEDIC) at 1-877-7SAFERX (1-877-772-3379)<\/span><\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><span style=\"font-weight: 400;\">Before calling, or creating a complaint, make sure you\u2019ve gathered all the information you can find about the service you\u2019re questioning\u2014date, provider, amount, your name, your Medicare number, and the reason you think Medicare should be billed.<\/span><\/p>\n<p><b>When you call or submit the claim, have the following ready:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Your name and Medicare number<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Your provider\u2019s name<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The service or item in question<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The amount that Medicare-approved and paid<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Your Medicare Summary Notice<\/span><\/li>\n<\/ul>\n<h2 id=\"what-happens-when-you-report-medicare-fraud\"><span style=\"font-weight: 400;\">What happens when you report Medicare fraud?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Filing false payment claims to Medicare can attract fines up three times greater than any loss incurred by this program plus $11,000 per claim filed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While a particular intent is not necessary in most cases; reckless behavior will result in imprisonment if discovered after the fact during an investigation into chargebacks related to Medicare fraud and abuse.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the <\/span><a href=\"https:\/\/www.justice.gov\/civil\/false-claims-act\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">False Claims Act<\/span><\/a><span style=\"font-weight: 400;\"> (FCA), the government may pay a reward of up to 30% to people who report fraud. \u201cIn the past five years, the federal government has paid more than $1.85 billion to healthcare whistleblowers,\u201d according to <\/span><a href=\"https:\/\/www.employmentlawgroup.com\/what-we-do\/whistleblower-protection-rewards\/medicare-fraud-attorney\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">The Employment Law Group.<\/span><\/a><\/p>\n<h3><span style=\"font-weight: 400;\">Which governmental agency is responsible for monitoring Medicare fraud?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">In partnership with other law enforcement agencies and health insurance groups, the <\/span><a href=\"https:\/\/www.fbi.gov\/scams-and-safety\/common-scams-and-crimes\/health-care-fraud\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Federal Bureau of Investigation (FBI)<\/span><\/a><span style=\"font-weight: 400;\"> is the primary agency for investigating health care fraud for insurance programs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Department of Health and Human Services Office of Inspector General (<\/span><a href=\"https:\/\/www.justice.gov\/archives\/jm\/criminal-resource-manual-978-health-care-fraud-and-abuse-control-program-and-guidelines\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">HHS-OIG<\/span><\/a><span style=\"font-weight: 400;\">) has also long been focused on fraud schemes within Medicare and Medicaid programs as well as public health programs like the IHS which includes Indian healthcare services.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Laws that govern Medicare fraud and abuse<\/span><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>False Claims Act<\/b><span style=\"font-weight: 400;\">: The civil FCA protects the government from being sold or overcharged for items and services.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Anti-Kickback Statute<\/b><span style=\"font-weight: 400;\">: The Anti-Kickback Statute is a law that prevents you from paying any form of remuneration to reward patient referrals. This includes cash, meals, and hotel stay as well as excessive compensation<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Exclusion Statute<\/b><span style=\"font-weight: 400;\">: This law applies to entities and individuals convicted of certain criminal offenses, which means they&#8217;re not allowed to participate in any federal healthcare programs.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The Physician Self-Referral Law:<\/b><span style=\"font-weight: 400;\"> Commonly known as the Stark Law, this law prohibits physicians from making referrals for designated health services to an entity in which they have a financial interest or where their family members work. Penalties against violators include fines and exclusion from all federal healthcare programs.<\/span><\/li>\n<\/ul>\n<h2 id=\"healthcare-fraud-prevention\"><span style=\"font-weight: 400;\">How to prevent Medicare fraud<\/span><\/h2>\n<h3><span style=\"font-weight: 400;\">1. Protect your private medical information.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Don\u2019t share your Medicare number, medical records, or Social Security number with anyone except healthcare providers, who need it for billing purposes. You should \u201ctreat your Medicare card like it\u2019s a credit card,\u201d according to <\/span><a href=\"https:\/\/www.medicare.gov\/forms-help-resources\/help-fight-medicare-fraud\/tips-prevent-fraud\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">medicare.gov<\/span><\/a><span style=\"font-weight: 400;\">, meaning that you don\u2019t want other people to steal your account number and use it for their own medical care. Clarkson recommends leaving your Medicare card at home unless you know you\u2019ll need it. \u201cYou should only take it with you when you\u2019re going to a doctor or a hospital,\u201d he says.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">2. Educate yourself.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Learn about how your Medicare plan works\u2014what can be billed to Medicare, what can\u2019t be billed to Medicare, covered services, and healthcare costs. Find out why your physician or another vendor is recommending certain services.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">3. Be wary and ask questions.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If it seems too good to be true, it probably is not on the up-and-up. Money or gifts in exchange for free medical care could be a sign of fraudulent activity or dishonest healthcare professionals. If a provider offers to bill for a service that isn\u2019t typically covered, find out how\u2014or why\u2014it\u2019s paid. It could be a false claim for a different service.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">4. Keep careful health records.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Track when you visited the doctor\u2019s office, and what tests you had at each visit. Write notes on what happened at each visit in a medical journal. When your statement arrives, check to make sure all the details are correct. If you fill a prescription drug (Part D), make sure it\u2019s for the correct medication and number of pills, and report any problems to the pharmacist.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">5. Don\u2019t fall for Medicare scams.<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Medicare doesn\u2019t send representatives to your home, so if a door-to-door salesman stops by your apartment or house, you\u2019re right to be suspicious. Representatives will only call you if you\u2019re already a member of the plan, or if you\u2019ve left a message.
