This Washington Consumer Health Privacy Policy (“WA Policy”) applies to information defined as “Consumer Health Data” under the Washington State My Health My Data Act (“MHMD”), relating to consumers residing in Washington and consumers whose Consumer Health Data is collected in Washington (herein referred to as “Washington Consumers”, “you”, or “your”).
Our Website collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device. The Consumer Health Data we collect depends on the context of your interactions with the Website. Categories of Consumer Health Data we may collect include the following, when collected in connection with your past, present, or future physical or mental health status:
Identifiers: such as name, telephone number, email address, username and password if you are a loyalty program member, IP address;
Commercial information: such as prescriptions and pharmacies searched and considered, loyalty program participation information;
Internet or other electronic network activity information: such as computer and connection information, statistics on page views, traffic to and from the websites, ad data and other standard weblog information;
Geolocation information: such as ZIP codes entered to see pharmacies nearby, as well as actual location when visitors grant access.
We collect information which may include Consumer Health Data directly from you when using our Website and from the following categories of sources:
On our websites and mobile applications
When you communicate with our Customer Service
Through participation in our loyalty program
Third party websites and mobile applications (e.g., websites and applications that share information with us or our advertising partners regarding your online activities)
Data Suppliers (e.g., companies that provide demographics and other information regarding consumers)
Joint marketing or other commercial business partners
Online advertising networks
Social media companies
Other service providers
We collect and use your Consumer Health Data as reasonably necessary to provide you with the products or services you have requested or authorized. For example, our collection and use of Consumer Health Data may include purposes such as to respond to your inquiries; fulfill your requests and improve your experience; improve the effectiveness of our services; comply with a legal obligation; or for related internal operations purposes as necessary and appropriate under applicable law.
We may share the categories of Consumer Health Data listed in the Consumer Health Data We Collect section for the purposes described in the Why We Collect and Use Consumer Health Data section. For example, we may share information, including Consumer Health Data, as reasonably necessary to provide any product or service you have requested or authorized. In addition, we may disclose Consumer Health Data, to comply with a valid legal process or to respond to such requests from public and government authorities.
As necessary for the purposes described above in the Why We Collect and Use Consumer Health Data section, we may share Consumer Health Data with the following categories of third parties. For clarity, third parties do not include vendors whom we contract with to help us provide you with products and services you request.
Parties to a Corporate Transaction. We may disclose information, which may include Consumer Health Data, with Business Partners or Purchasers, Professional Service Providers (e.g., consultants, lawyers, accountants), and Data Analytics Providers involved in the evaluation of or entry into the sale or purchase of company assets, mergers, or acquisitions.
Public and Government Authorities. We may disclose Consumer Health Data to public and government authorities (including law enforcement) when reasonably necessary to comply with a legal process or in litigation where the data is pertinent.
Affiliates. We may share your Consumer Health Data with our parent company and affiliates.
We do not share mobile contact information with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors in support services, such as customer service. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
MHMD provides certain rights to Washington Consumers with respect to their Consumer Health Data, subject to certain exceptions. You have the right to access and request deletion of your Consumer Health Data we may have collected, shared, or sold. If you provided consent for collection or sharing of your consumer health data, you have the right to withdraw your consent. In addition, you have the right to appeal our refusal to act on your request. If your appeal is denied, you may submit a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.
